The SEC’s Plan of Operations In the Event of a Government Shutdown

Faced, yet again, with the possibility of a government shutdown (tomorrow at midnight), the Securities and Exchange Commission has published its latest Plan of Operations During a Lapse in Appropriations.

A few highlights from the Plan, which is embedded below:

  • The Commission will continue to address emergency enforcement matters and ongoing litigation that cannot be deferred.
  • EDGAR and other filing systems will remain functional.
  • The processing and approval of filings and registration statements will be discontinued.
  • All non-emergency rulemaking, interpretive advice, no-action letters and pending applications for exemption will also be discontinued.
